Nine Ice Cream & Gelato Parlor checks covering the single piece of equipment that touches every serve you sell: the scoop. Between-use storage has a legal answer. Food Code 3-304.12 allows running water of sufficient velocity to flush particulates to the drain, or water held at 57°C (135°F) or above. A stagnant, unheated dipper well meets neither. Between-use scoop storage that passes inspection

1. Run the dipper well with enough water flow to flush food bits down the drain. Aim for at least 0.2 gpm (0.76 L/min).Running water is what makes it legal to store scoops between uses. The flow rate is the difference between following the rules and a high water bill.
2. Heated well: keep the water at 57°C (135°F) or above and change it every 4 hours. Log each change.A heated well only works while the water is hot and fresh. If you don't log a change, assume it wasn't done.
3. Never leave a scoop sitting in still, unheated water between uses.Still, lukewarm water is the most common citation for scoop shops. It's full of bacteria, and you dip into it with every serve.

Keep the served product clean

4. Swap scoops for washed ones on a fixed schedule, by the clock, not just when they look dirty.Judging by eye is how a scoop stays in use all day without a wash. A fixed swap time is easy to check and easy to defend.
5. Store spare scoops, spades, and cone equipment covered and protected, not sitting loose on the cabinet rail.Inspectors cite frozen-dessert shops most often for equipment storage and contamination protection. Uncovered equipment is the easiest point to lose.
6. Wash your hands and change gloves every time you switch tasks: cash, then scoop, then cones, then cleaning.Staff hands are the documented contamination route into ice cream at retail. Poor hygiene fails about two-thirds of inspections. Hands pick up germs when you switch tasks.
7. Soft-serve: check the mix is holding at 5°C (41°F) or below. Do the manufacturer's full strip-down clean on schedule. Log both.Warm mix and a machine that isn't fully cleaned are how soft-serve fails a health inspection swab test. Each failure can cost you a day of business.

Allergen orders

8. For an allergy order, use a fresh washed scoop from the dedicated kit. Take it from an untouched part of the tub.A shared scoop and a picked-over tub surface are the cross-contact route customers can't see and won't forgive.
9. Never answer an allergen question from memory. Read the current allergen chart out loud, every time.Feeling sure is not the same as being right. Most staff feel confident but get details wrong, and the shop usually already 'knew' the answer.

What are the rules for storing ice cream scoops between uses?

FDA Food Code 3-304.12 permits in-use utensil storage only by defined methods. These include: in the food with handles above the food and container, in running water of sufficient velocity to flush particulates to the drain, or in a container of water maintained at at least 57°C (135°F). A stagnant, unheated dipper well meets none of them. EPA WaterSense also notes heated dipper wells require manual replacement of the water every four hours. Log each change rather than trusting memory.

What flow rate should a dipper well run at?

EPA WaterSense records that traditional continuous dipper wells are typically set between 0.2 gpm (0.76 L/min) and 1.0 gpm (3.8 L/min). Most existing wells run at about 0.35 gpm (1.3 L/min) or more. That is against the no more than 0.2 gpm (0.76 L/min) that EPA WaterSense records some voluntary codes and standards as recommending. The figure is EPA-published, but it is those codes and standards recommending it, not EPA setting a standard of its own. The flow still has to be sufficient to flush particulates to the drain, to satisfy Food Code 3-304.12. So set it deliberately, at open, rather than leaving it wherever the last person turned the tap.

How do you serve an ice cream order safely for a customer with a nut allergy?

Use a freshly washed scoop from a dedicated allergy kit. Take the portion from an untouched tub surface. Read the current allergen matrix out loud, rather than answering from memory. In a study of 156 peanut and tree-nut reaction episodes in food establishments, 14% occurred in ice cream shops. 23 of 106 self-ordered reactions (22%) were attributed to contamination primarily from shared serving supplies. In 78% of those cases, someone in the establishment already knew the food contained the allergen. Knowing is not the control. The clean scoop is.
